Terms of Service

For the purposes of these Terms, the following definitions apply:

• "Game" or "Epinikia": the Epinikia Game platform, its smart contracts, on-chain components, web application, APIs, and all associated services operated by Epinikia Foundation, accessible at epinikiagame.com.
• "Foundation": Epinikia Foundation, the Swiss legal entity operating the Game.
• "User": any natural person who creates an account and uses the Game.
• "Draw": a scheduled on-chain lottery event with defined ticket submission deadlines and prize pools.
• "Ticket": a registered set of numbers submitted by a User for a given Draw, recorded on-chain.
• "$EPI": the native utility token of Epinikia Game used for fees, staking, rewards, and governance.
• "Points": off-chain reward credits accumulated through Game participation, convertible to $EPI according to the airdrop schedule.
• "Prize": a monetary or token reward attributed to a winning Ticket as determined by the cryptographic draw mechanism.
• "Fraudulent Activity": any attempt to manipulate draws, exploit system vulnerabilities, create multiple accounts for bonus farming, or otherwise gain an unfair advantage.

To use the Game, you must:

• Be at least 18 years of age, or the legal age of majority in your jurisdiction if higher;
• Not be a resident of a jurisdiction where lottery participation or the use of the Game is prohibited by law;
• Have full legal capacity to enter into binding agreements;
• Not be an employee, contractor, officer, director, or immediate family member of Epinikia Foundation.

By creating an account, you represent and warrant that all information you provide is accurate, current, and complete. The Game reserves the right to suspend or permanently ban any account where eligibility requirements are not met or where misrepresentation is detected, with or without prior notice, and without any obligation to pay pending prizes or refund purchased tickets.

Users are limited to one account per person. The creation of multiple accounts to accumulate bonuses, referral rewards, or any other Game benefit constitutes a material breach of these Terms and may result in immediate account termination and forfeiture of all Points and prizes.

Each Draw is governed by specific rules published at the time of its creation, including but not limited to: eligible number ranges, ticket limits per user, prize tiers, and deadline timestamps. These per-draw rules form an integral part of these Terms.

Ticket submissions are final and irrevocable once confirmed on-chain. Users may not modify, cancel, or withdraw a submitted Ticket after confirmation, under any circumstances.

The Draw deadline (deadline_ts) is enforced with absolute precision at the on-chain level. No Ticket submitted after this timestamp will be considered for the corresponding Draw, regardless of the reason for the delay.

The Game uses a cryptographic commit-reveal scheme. A hash commitment to the entropy seed is recorded on-chain prior to any ticket submission. The seed is revealed only after the deadline. This mechanism guarantees that winning numbers cannot be known or influenced by any party — including the Foundation — prior to the reveal. The resulting winning numbers are computed deterministically from the revealed seed and are final and non-contestable.

The Foundation retains the absolute and unconditional right to withhold, suspend, or permanently cancel any prize payment in the following circumstances, without limitation:

• Suspected or confirmed Fraudulent Activity: including but not limited to bot usage, coordinated manipulation, exploit usage, or any form of system abuse;
• Breach of these Terms: including eligibility violations, multi-account creation, or misrepresentation;
• Technical anomalies: where the draw process experienced a verifiable technical failure that may have compromised result integrity, at the Foundation's sole discretion;
• Regulatory requirements: where applicable law requires the Game to withhold payment pending identity verification, KYC/AML compliance, or tax documentation;
• Suspicious activity patterns: where the Foundation reasonably suspects, in its sole and unreviewable discretion, that a winning outcome was obtained through manipulation, exploitation, or any means inconsistent with fair participation.

The Foundation's determination regarding the withholding of any prize is final and binding. Users acknowledge that on-chain computation of a winning result does not automatically entitle the User to receive the corresponding prize if any of the above conditions apply.

Prize claims not made within 180 days of the draw reveal date shall be permanently forfeited and returned to the Game's prize reserve fund, without any compensation to the User.

Prize payments are made in the currency or token specified for each Draw. The Foundation bears no responsibility for exchange rate fluctuations or the cost of converting prizes to any other currency.

The following conduct is strictly prohibited and may result in immediate account termination, forfeiture of all accrued Points and prizes, and referral to the relevant authorities:

• Using automated scripts, bots, or non-human means to interact with the Game;
• Attempting to reverse-engineer, decompile, or exploit the Game's smart contracts or backend infrastructure;
• Colluding with other users to manipulate draw outcomes;
• Creating multiple accounts or abusing referral systems with fake accounts;
• Circumventing geographic restrictions using VPNs, proxies, or similar tools;
• Attempting to interfere with the cryptographic commit-reveal mechanism;
• Any form of money laundering or use of the Game to process proceeds of crime;
• Impersonating the Foundation, its employees, or other users.

The Foundation employs automated fraud detection systems that monitor all on-chain and off-chain activity. Detection of prohibited conduct may result in immediate and permanent suspension without notice, with no right of appeal.

Users are solely responsible for the security of their account credentials. The Foundation accepts no liability for losses resulting from unauthorised account access due to User negligence, including but not limited to password sharing or phishing.

Points are non-transferable off-chain credits that reflect a User's level of engagement with the Game. Points have no monetary value and do not constitute financial instruments.

The conversion of Points to $EPI tokens occurs through airdrop phases as described in the Game Whitepaper. The Foundation reserves the right to modify, suspend, or cancel the airdrop schedule at any time, for any reason, without compensation to users.

$EPI tokens are utility tokens. They are not securities, investment instruments, or financial products. No representation is made as to their future value. Holding or using $EPI does not confer any ownership right, dividend right, governance right (unless explicitly granted), or claim against the Foundation.

Points may be retroactively adjusted, suspended, or cancelled by the Foundation in cases of detected abuse, system errors, or policy changes. Users have no vested right in accrued Points until they are converted to $EPI through an official airdrop event.

Where staking of $EPI is available, users may lock their tokens in the Game's staking contract in exchange for reward distributions. Staking rewards are variable and are not guaranteed. The Foundation may modify, reduce, or discontinue staking rewards at any time with reasonable notice.

Staked tokens are subject to the lock-up periods specified at the time of staking. Users may not unstake before the lock-up period expires except through mechanisms explicitly provided by the Game. The Foundation accepts no liability for opportunity costs arising from staking lock-up periods.

Staking participation does not constitute an investment contract, and staking rewards do not constitute returns on investment.

The Foundation reserves the right to modify these Terms at any time. Material changes will be notified via epinikiagame.com and, where applicable, by email. Notification of changes constitutes acceptance of the new Terms upon continued use of the Game.

If you do not agree with amended Terms, your sole remedy is to cease using the Game. No compensation is owed for the suspension of service resulting from refusal to accept updated Terms.

These Terms shall be governed by and construed exclusively in accordance with Swiss law, excluding its conflict-of-law provisions.

All disputes arising out of or in connection with these Terms — including questions regarding their existence, validity, breach, or termination — shall be subject to the exclusive jurisdiction of the courts of the Canton of Zug, Switzerland.

Prior to initiating formal proceedings, users agree to first submit their dispute in writing to legal@epinikiagame.com and allow the Foundation 30 calendar days to respond and attempt resolution. This pre-litigation notice is a mandatory condition precedent to any legal action.

Notwithstanding the above, the Foundation may seek immediate injunctive or other equitable relief in any court of competent jurisdiction to prevent irreparable harm without being required to post a bond or other security.

Class actions and collective proceedings are expressly waived. All claims must be brought in the User's individual capacity only.

The Game is committed to responsible gaming. The Foundation provides self-exclusion tools and account suspension mechanisms to users who request them.

Lottery participation involves an inherent risk of financial loss. Users acknowledge that winning is not guaranteed and that past performance does not predict future results. The Game does not target vulnerable persons and prohibits participation by minors.

If you believe you are experiencing gambling-related harm, please contact your local responsible gaming authority or cease using the Game immediately by requesting account suspension at support@epinikiagame.com.

If any provision of these Terms is found to be unenforceable or invalid by a court of competent jurisdiction, that provision shall be modified to the minimum extent necessary to make it enforceable, and all remaining provisions shall continue in full force and effect.

These Terms, together with the Legal Mentions and Privacy Policy, constitute the entire agreement between the User and the Foundation with respect to the Game and supersede all prior negotiations, representations, warranties, and understandings.

The Foundation's failure to enforce any right or provision of these Terms shall not constitute a waiver of that right or provision.
